IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF SEASONS PIZZA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO SEASONS PIZZA IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Nothing in these Terms shall limit or exclude any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by gross negligence, fraud, or any other liability that cannot be lawfully excluded or limited.

10. Indemnification

You agree to defend, indemnify, and hold harmless Seasons Pizza, its owners, officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way related to:

14.3 Class Action Waiver

YOU AND SEASONS PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND SEASONS PIZZA BOTH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or other irreparable harm. Nothing in this section shall prevent Seasons Pizza from seeking injunctive or other equitable relief from the courts where necessary.

Seasons Pizza shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions or restrictions, labor disputes, supply chain disruptions, power outages, internet service failures, or civil unrest ("Force Majeure Events"). In the event of a Force Majeure Event, we will make reasonable efforts to resume normal operations as soon as practicable.
